This Indenture made this 15th day of August in the year of our Lord, 1712 between Thomas Mercer Sr. & Joseph Mercer of the County of Norfolk of the one part and John Mercer ,Sr and Ruth, his wife of the same county of ye other part, witnesseth that the said Thomas & Joseph Mercer , for and in consideration of the natural love and affection they have and do bear unto the said John Mercer Sr. & Ruth his wife , and other considerations, them thereunto more especially moving, have demised , Let and to for in Let unto said John Mercer Sr. & Ruth his wife , all that messuage, tenement and plantation of Land, commonly known by the name of Chincopine Ridge, with the appurtenances whereon the said John Mercer Sr. & Ruth his wife doth now inhabit and dwell , situate and being in the Southern branch in the County of Norfolk , together with all houses, Edifices, buildings, barns, orchards, gardens, common wayez, Easements whatsoever to the said messuage, Tenement and premises or any of them belonging, or in any wise appurtaning and now used therewith , except all woods, Timber and Timber Trees growing or to be growing on the premises , or any of them more that shall be needful and necessary for the use and benefit of ye plantation and firewood, etc. To have and hold that messuage, tenement and plantation of Land and all the other premises with the appurtenances (except before excepted) with the said John Mercer Sr. & Ruth his wife, for , and during the term of their natural Life, and the Life of the longer liver of them, successively one after another , as they are herein named, yealding and paying therefore the yearly (rent) , and Every year during the said Terme hereby demised unto the said John Mercer Sr. & Ruth his wife, the yearly rent of one Ear of Indian Corne Every New Years Day and the said Thomas Mercer Sr. & Joseph Mercer for themselves, their heirs and assigns and for Every of them , doth covenant and by these presents, that the said John Mercer Sr. & Ruth his wife, by and under the yearly rent covenants and conditions on and by these presents Reserved and on their part Severally to be paid down and performed according to the Intent of these present shall, or may, peaceably and Quietly hold and Enjoy the said messuage Tennements of Lands and all premises with their appurtenances without Suit, Let, Trouble, Disturbances, Denials, Molestation, Interruption, or Eviction of them the said Thomas Mercer Sr. & Joseph Mercer, their heirs or assigns, and of all and Every other person or persons whatsoever Lawfully claiming, by, from or under them, the said Thomas Mercer Sr. & Joseph Mercer on his or their or any of their Estate , right or Title, in witness whereof the said Thomas Mercer Sr. & Joseph Mercer have hereunto set their hands and Seals the day and year first above written . It is agreed upon, before signing by Thomas Mercer Sr. & Joseph Mercer that is the said John Mercer Sr. or his wife Ruth should move off ye said plantation to live elsewhere that sail land shall be retuned to Land of Thomas Mercer Sr. & Joseph Mercer again and not let out.

Notes from Mary Markley
From the Colonial & State Records of NC, Vol. 12, pp75-77 & 939: Joseph Mercer, Noah Mercer(also referred to as Nash) and 4 others were Tories who were charged with killing Nathaniel Richardson in Nov 1776. The Chairman of the Committee to consider of Ways and Means for apprehending and bringing to justice the Tories in Bladen County resolved “it be recommended to the Congress that the sum of 100 lbs be offered as a Reward for taking and securing Joseph Mercer, and the sum of 500 lbs be offered for taking and securing each of the following Persons, to wit, Jacob Cairsy, Ambrose Bullard, James Piercy, William Biggs, and Noah Mercer……in case of Resistance or Flight of said (persons) to kill and destroy them, any or every of them, without any Impeachment for the same.”

Oct 5 th, 1798 Deed Book D page 322 " from Solomon Mercer of Georgetown District, S.C. to Harris Spear of Robeson conveying 150 acres patented by Robert Grier and by him deeded to Joseph Mercer and which became confiscated by his attachment to the enemies of this country in the late War and which was restored to June ( Jane ??) Mercer, wife of the said Joseph Mercer, by the Robeson County Court and by her was sold to John Willis and is now in the Grantee's possession ; whereas, some doubts have arisen that the aforesaid Solomon Mercer as eldest son and heir of his said father, Joseph Mercer, could claim same by inheritance, but he the Grantor well knowing his said Mother did sell to John Willis" Source NGS Quarterly, Vol 43 page 91
