In The Name of God Amen
I Roland Mercer of the County of Robeson & State of North Carolina Being of sound mind and memory, considering the uncertainly of my Earthly existence do make and declare this to be my Last Will and Testament in manner & form following that is to say
First that my (Executor hereinafter named)Shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts howsoever and whomsoever owing out of the moneys that may first comes into his hands as a part or parcel of my estate .
Item 1st I give and devise to my brother James Mercer one Dollar to be paid by my Executor.
Item 2nd I give and devise to my sister Easter Phillips one Dollar to be paid by my Executor.
Item 3rd I give and devise to my brother Noah Mercer one Dollar to be paid by my Executor.
Item 4th I give and devise to my sister Melitia Mears one Dollar to be paid by my Executor.
Item 5th I give and devise to my sister Francis Phillips one Dollar to be paid by my Executor.
Item 6th I give and devise to my brother Travis Mercer dec’d child Josephine Empie Mercer one Dollar to be paid by my Executor.
Item 7th I give and devise to my sister Rosa Ann Phillips one Dollar to be paid by my Executor.
Item 8th I give and devise to my sister Nepsey Ann Byrd, wife of Owen Byrd one Dollar to be paid by my Executor.
Item 9th I give and devise to my beloved wife Martha Ann Mercer all my real estate in Robeson County estimated to contain four hundred and seventeen and one half acres Land to her during her natural life to use in any manner she may see proper .
Item 9th I give and devise to my wife Martha Ann Mercer all ny personal property of every description consisting of money, notes and accounts that I may have on hand or may be due or owing to me at my death also all my stock of all kinds and descriptions all my farming utensils all my crop and provisions on hand all my household and kitchen furniture of every kind and description and in fact everything own or possess not otherwise disposed of in this my Last Will and Testament
My will and desire is that Eleanor Jane Baxley now living with me shall if she marry satisfactory to my wife Martha Ann Mercer have one bed and furniture when she marries given to her.
My will and desire is that all my property of every description remaining on hand at the death of my wife shall be the property of Eleanor Jane Baxley now living with me if she marries satisfactory to my wife.
And Lastly I do hereby constitute and appoint my trusty friend James A Phillips my lawful Executor to all intent and purposes to execute this my Last Will and Testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other wills and testaments by me heretofore made.
