Last Will & Testament of
James Shy /1766
of Hancock County Georgia

In the name of the Ever living God -- I James Shy of the county of Hancock beign now of sound and disposing mind & memory and desiorus of disposing of the property which God in his mercy has enabled me to accumulate -- do make and declare this as my last will and testament.
First I commend my soul to my Redeemer __ and my body to be interred in Christian
burial.
SecondlyI give my beloved wife a full and comfortable support from my estate in the
hands of my four children herein after named ; she to be provided with everything
that may conduce to her comfort during life--- and that she reside if she pleases with
any of them , or whereever she may desire at their joint expense.
Thirdly.I give my son John two Thousand dollars to be paid from monies due me at my
decease--- and if that be not enogh due me to pay this legacyafter paying what few
just debts that I may owe, then the residue to be raised by the cultivation of my lands.
Fourthly As to my Daughter Betsy Dickson - I give her nothing ----- as I have already advanced to her & her husband from time to time a fair portion of my estate.
FithlyAll the rest & residue of my estate real & personal of every kind I give and devise
to my four children--- John, Peggy , Nancy, & Sally -- to be equally divided between
them and where any one of them shall require a division after the payment of the
above legacy. I direct that the divison be made by friends Hardy C. Culver, Jesse
Lockhart & William H. Sayre ; and if any of said persons should be dead or removed,
from theCounty -- or shall decline to act. -- I request & direct that the vacancy of such
person or persons be supplied by the Court of Ordinary of this county by selecting one
or more Judicious persons for the purpose of making the divison __ And I enjoin on
my said Children not only to support their Mother as herein before directed, but to
continue to her their dutiful respect & affection.
LastlyI nominate and appoint my son John Shy___ and my friend John S Latimer
Exceutors of this my will__ Hereby revoking any and all former wills if any be in
existance.
In witness whereof I have hereto set my hand and seal This twenty second day of
August 1839.

A paper purporting to be the last will and testament of James Shy late of said county
deceased having been produced into open court by John S. Latimore one of the nominated Executors of the said deceased named in said written instrument and the due & legal execution whereof and the scruity of the testator having been proven by the evidence of Henry Rodgers , one of the witnesses thereto .
It is ordered that said written instrument is fulley proven to be the last will and testament of the said James Shy and that the same as such be admitted to record.
