Written: May 26 1848
Will of James Freeman
Georgia, Jasper County
In the name of God amen.
I James Freeman of said county in very feeble health but of sound and
disposing mind do in contemplation of my approaching dissolution- make the
following last will and testament- hereby revoking all other wills by me
heretofore made.
Item 1st., I will that my just debts be paid as soon as convinent for my
executor to do so.
Item 2nd
I will that after the payment of my just debts that my estate be
divided into nine parts- and the that the realty and personalty of ever
description be considered my estate that my wife Patsy Freeman- take one share
and that each - and that each of my children (to wit) Newton, Hopson,
Floyd,George, Jaboy, Louisa- the wife of Levi Waits, Caroline Yates, and
Lucinda the wife of George T. Waits, each have one share.
Item 3rd
The share or distributive part of my estate that I give to my daughter Louisa
Waits, I give in trust to George Freeman-(my Son) as trustee for her and her
children to be held by said trustee during the life of my said daughter Louisa
for her sole and separate use and benefit- entirely free and independent of the
control or direction of the husband- and in no wise liable for his debts-
hereto fore or hereafter contracted- and after the death of my said daughter
Louisa, I direct that the said George Freeman act as trustee of the said
property, for the benefit of the children of my said daughter Louisa- during
their minority or unmarried state, & as they arrive at age or marry , then said
trustee to deliver up to such child their just proportion of said property- my
daughter during her life is to receive the sole benefit of the said property -
and after her death her childre are to receive it .
Item 4th
I hereby appoint George Freeman my Executor of this my last will and testament.
In witness of all which I have here unto set my hand and Seal- this 13 day of
May 1848

Personally came before us Cardin Goolsby, John J Griggs, Alexander Waits who
disposed & sworn that they saw James Freeman whose name is subscribed above
signed declare and publish the above will to be his last will and testament and
at the time of doing so he was of sound mind and disposing memory that we
signed the same as witnesses & saw each other do the same.
